Photovoltaik AGBs:

  1. The VAT rate of 0% according to §12, para. 3 UstG from 01.01.2023 applies exclusively to solar modules and the essential components for operating a photovoltaic system, including the storage of the electricity generated by the solar modules. This tax exemption only applies to operators of photovoltaic systems if these systems are installed on or near private homes, dwellings and public and other buildings used for non-profit purposes. The installed plant size must not exceed the gross power of 30 kW (peak) according to the market master data register in order to meet this requirement.
    The buyer declares at the conclusion of the purchase contract at a VAT rate of 0%, that he is acting as operator of a photovoltaic system and meets the conditions described in paragraph (1). A registration in the Market Master Data Register must be made under the customer’s name within 6 months of purchase. If this is not the case, BOGA reserves the right to charge the statutory value added tax retroactively.
