The zero VAT rate according to section 12, paragraph 3 UstG applies from 01.01.2023 for solar modules as well as for essential components for the operation of a photovoltaic system, including the storage system, for storing the electricity generated with the solar modules. This only applies to photovoltaic system operators if the photovoltaic system is installed in or near private residences, apartments and public and other buildings used for non-profit purposes. The maximum output of the system may not exceed 30 kW (peak) according to the market master data register.
By concluding the purchase contract with a zero VAT rate, the buyer confirms that he is purchasing as a photovoltaic system operator and fulfills the requirements described in paragraph (1). The entry in the market master data register under the customer’s name must be made within 6 months of the purchase, otherwise BOGA reserves the right to claim the statutory VAT.
